Terms of Service

These Terms govern your use of Hyperwick (the "Service"), operated from the United Kingdom ("we", "us"). By using the Service you agree to these Terms, our Privacy Policy and our Risk Disclaimer. If you don't agree, don't use the Service.
1. What Hyperwick is — and what it is not
Hyperwick is a software tool for charting, price/market alerts and public wallet intelligence on Hyperliquid. It is informational software only.
Hyperwick is not a broker, exchange, wallet, custodian, money services business, crypto-asset service provider, or financial adviser. As set out in the Risk Disclaimer, it is not authorised or regulated by the Financial Conduct Authority or any other regulator, and nothing it provides is financial advice.
2. Eligibility, sanctions & restricted locations
- You must be at least 18 and legally able to enter into these Terms.
- You are responsible for your account, your sign-in method, and everything done under your account.
- You must give accurate information and keep your access secure.
- You represent that you are not on any UK (OFSI), EU, United Nations or U.S. (OFAC) sanctions or "specially designated" list, and that you are not resident in, or accessing the Service from, a country subject to comprehensive sanctions or embargo. You may not use the Service where doing so is prohibited by the laws that apply to you.
3. Acceptable use
You agree not to: break the law; abuse, overload, scrape, reverse-engineer, or disrupt the Service; attempt to bypass limits or security; resell the Service without permission; or use it to harm others. We may suspend or terminate accounts that breach these Terms.
Without our written permission you also may not: exceed published rate limits or circumvent usage limits; resell, redistribute or commercialise our data or any API; use the Service or its data to build, train or benchmark a competing product; or share your access credentials or any API key with third parties.
4. Subscriptions, billing & cancellation
- Paid plans (Scout, Sniper, Whale) are billed monthly in advance through Stripe. Prices are shown at checkout.
- Subscriptions renew automatically each month until you cancel.
- You can cancel at any time; cancellation stops future renewals and takes effect at the end of the current paid period. Your plan features remain until then.
- Refunds: because access is delivered immediately, payments are generally non-refundable except where required by law. If something went wrong, email [email protected] and we'll deal with it fairly.
- We may change prices or plan features with reasonable notice; changes apply from your next renewal.
- Free-tier limits (e.g. number of active alerts) apply as shown in the app and may change.
- Prices are exclusive of any taxes unless stated. You are solely responsible for determining and paying any taxes that apply to you.
5. No financial advice — alerts are best-effort
Nothing in the Service is financial, investment, legal or tax advice. Alerts, charts, indicators and "smart-money" or screener data are provided for information only, on an "as-is" and "as-available" basis, and may be delayed, missed, incomplete or wrong. You are solely responsible for your own trading decisions. See the full Risk Disclaimer, which forms part of these Terms.
6. Availability
We aim for high reliability but do not guarantee the Service will be uninterrupted, error-free, or that any alert will be delivered on time or at all. We may modify, suspend or discontinue features.
7. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement.
8. Limitation of liability
To the fullest extent permitted by law, we are not liable for any trading or investment losses, missed or delayed or incorrect alerts, loss of profits, data, or goodwill, or any indirect or consequential loss arising from your use of (or inability to use) the Service. Nothing in these Terms excludes liability that cannot be excluded by law (such as for death or personal injury caused by negligence, or fraud). Where liability cannot be fully excluded, our total liability to you is limited to the greater of £50 or the amount you paid us in the 3 months before the claim.
9. Your indemnity
You agree to indemnify and hold harmless Hyperwick, its operator and its people from and against any claims, liabilities, losses, damages, costs and expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms or of the law, your trading or investment decisions, or anyone using your account. This does not apply to the extent a loss is caused by our own breach and cannot be excluded by law.
10. Intellectual property
Hyperwick and its content are owned by us or our licensors. You keep ownership of content you create (e.g. your Pine scripts); you grant us the licence needed to operate the Service for you.
11. Termination
You can stop using the Service and delete your account at any time (email [email protected]). We may suspend or terminate access if you breach these Terms or where necessary to protect the Service or comply with law.
12. Changes to these Terms
We may update these Terms; the "last updated" date will change and material changes will be notified in-app or by email where appropriate. Continued use after changes means you accept them.
13. General
Force majeure: we are not liable for any delay or failure caused by events beyond our reasonable control, including outages of third-party data, infrastructure or networks, acts of God, war or terrorism, or government action. Severability: if any clause is unenforceable, the rest stay in force. Assignment: you may not assign these Terms; we may assign them (for example on a sale or reorganisation of the business). Entire agreement: these Terms, the Privacy Policy and the Risk Disclaimer are the entire agreement between us on their subject matter. No waiver: if we do not enforce a right, that is not a waiver of it.
14. Governing law
These Terms are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction, subject to any mandatory consumer-protection rights you have in your country of residence.
